Terms of Service

Who you are contracting with

BeatGuess is operated by Pierre Wigardt, a sole trader based in Sweden, trading under the name "BeatGuess" ("we", "us"). By creating an account or otherwise using BeatGuess you enter into a binding agreement with Pierre Wigardt on the terms below and our Privacy Policy.

The service

BeatGuess is a web app that lets you build music quizzes and host them live for friends. Some modes use the Spotify Web API and Web Playback SDK; those features require an active Spotify Premium account and the host's permission.

Acceptance & eligibility

You must be at least 13 years old (or the minimum digital-consent age in your country, whichever is higher) to use BeatGuess. If you use the service on behalf of an organisation, you confirm you have authority to bind it.

Pricing, payments & Merchant of Record

BeatGuess is free to use for standard quizzes. Premium modes (AI / music-powered quizzes) are free for the first two premium quizzes; thereafter a one-time upgrade to "BeatGuess Pro" is required. Current pricing is published on the /pricing page.

Payments are processed securely through our payment provider, Stripe. Card details are handled solely by Stripe within their PCI-DSS environment and never reach our servers. Applicable taxes are calculated and added at checkout based on your billing country.

"BeatGuess Pro" is a one-time purchase that unlocks unlimited premium quizzes for the lifetime of the service for the purchasing account. There is no recurring subscription and no automatic renewal.

"Lifetime" means the operational lifetime of the BeatGuess service. We may modify, restructure, or discontinue the service with at least 30 days' prior notice. Existing Pro purchases will retain equivalent access for as long as the service is operated. Pricing, features, and free-tier limits for new customers may change at any time without affecting your existing purchase.

Intellectual property

The BeatGuess software, design, brand, name and logo are owned by Pierre Wigardt and protected by intellectual-property laws. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the service for its intended purpose. You may not copy, modify, reverse-engineer, resell or redistribute the service or any part of it.

You retain ownership of the quiz content you create. By submitting content you grant us a limited licence to host, process and display it solely so we can provide the service to you and your players.

Spotify content

All music, album art, artist names and metadata accessed through Spotify remain the property of Spotify AB and the underlying rights holders. You may not download, redistribute, or use Spotify Content outside of normal use of this app. BeatGuess is an independent application that uses Spotify's APIs; we are not affiliated with or sponsored by Spotify. Your use of Spotify features is also governed by the Spotify End User Agreement.

Acceptable use

  • Don't try to bypass authentication, scrape data you don't own, or attack the service.
  • Don't upload illegal, harassing, infringing or hateful content as quiz questions.
  • Don't impersonate others or misuse another person's Spotify account.

We may suspend or terminate accounts for material breach, fraud, security risk, non-payment, or repeated/serious policy violations.

Disclaimer & liability

The service is provided "as is" without warranties of any kind, express or implied, to the fullest extent permitted by law. Spotify playback, AI generation, and live sync depend on third-party services that may be unavailable at times. To the extent permitted by law, our aggregate liability for any claim arising out of or relating to BeatGuess is limited to the amounts you paid us in the 12 months preceding the event giving rise to the claim. We exclude liability for indirect, incidental or consequential damages. Nothing in these Terms limits liability for fraud, gross negligence, or personal injury where such limitation is not permitted.

Governing law

These Terms are governed by the laws of Sweden. Disputes shall be brought before the competent courts of Sweden, without prejudice to mandatory consumer-protection rights in your country of residence.

Changes

We may update these Terms; significant changes will be highlighted in the app.
